InnovativeAI Inc. (hereinafter referred to as "the Company") establishes the following Terms of Service regarding the handling of personal information in this service.

Article 1 (Purpose and Application)

  1. These Terms of Service (hereinafter referred to as "these Terms") establish the terms of use for the Service provided by the Company.
  2. Users of this Service (hereinafter referred to as "Users") shall use this Service after agreeing to these Terms. If a User uses this Service, they shall be deemed to have agreed to all of these Terms.
  3. The Company may establish guidelines, privacy policies, and other regulations (hereinafter collectively referred to as "Other Regulations") necessary for the use of this Service. Other Regulations shall constitute part of these Terms regardless of their name.
  4. In the event of any inconsistency or conflict between these Terms and Other Regulations, the provisions of the Other Regulations shall prevail.

Article 2 (Definitions)

The definitions of terms used in these Terms are as follows:

  1. "Service" refers to the website "ResumeNow" operated by the Company.
  2. "User" refers to individuals or legal entities (including recruiting companies and recruitment agencies) who use this Service.
  3. "Recruiter" refers to companies or businesses (including hiring companies and recruitment agencies) that post job information through this Service.
  4. "Individual User" refers to individuals who register as members and use this Service for job hunting and career change activities.
  5. "Registration Information" refers to all information registered by Users or acquired by the Company for the use of this Service.
  6. "Resume Information" refers to career history, self-promotion, and other information related to applications and scouting registered or posted by Individual Users on this Service.

Article 3 (Member Registration and Application)

  1. To use functions that require member registration, Users shall apply for member registration in the manner prescribed by the Company.
  2. Users become members of this Service (hereinafter referred to as "Members") when the Company approves their application.
  3. If there is any change to the information provided during member registration, Users shall promptly update such information through the procedure prescribed by the Company.

Article 4 (Non-Approval and Cancellation of Member Registration)

  1. The Company may not approve a User's registration application or may cancel registration even after approval in any of the following cases:
    1. When the User has provided false information during registration
    2. When the User is a minor, adult ward, person under curatorship, or person under assistance, and has not obtained the consent of their legal representative, guardian, curator, or assistant
    3. When the User is an anti-social force or has a relationship with such forces
    4. When the User has violated these Terms in the past or is currently in violation
    5. When the Company determines that the registration is inappropriate for other reasons
  2. If a User wishes to cancel their member registration, they shall follow the procedure prescribed by the Company.

Article 5 (Account Ownership and Management)

  1. Users shall be responsible for managing their login information (ID, password, etc.) and shall not allow any third party to use it.
  2. Users shall be responsible for any damages caused by insufficient management, misuse, or use by a third party of their login information.
  3. If Users discover that their login information has been stolen or used by a third party, they shall immediately notify the Company and follow the Company's instructions.

Article 6 (Usage Fees)

  1. Users shall pay the usage fees prescribed by the Company for the use of paid services.
  2. Users shall pay the usage fees by the payment method prescribed by the Company.
  3. Usage fees already paid shall not be refunded in principle, except in cases where the Company determines otherwise due to unavoidable circumstances attributable to the Company.

Article 7 (Registration and Management of Resume Information)

  1. Individual Users may register and manage their resume information on this Service.
  2. Individual Users shall be responsible for the content of their resume information and shall ensure that it is true, accurate, and up-to-date.
  3. Individual Users shall not include personal information of third parties (individuals other than themselves) or information that infringes on the rights of others in their resume information.

Article 8 (Prohibited Acts)

  1. Users shall not engage in the following acts when using this Service:
  2. Acts that violate laws, regulations, public order, or morals
  3. Acts related to criminal activities
  4. Acts that infringe on the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of the Company or a third party
  5. Acts that discriminate against or defame others, or damage their reputation or credibility
  6. Acts that transmit or post harmful computer programs or other harmful data
  7. Acts that interfere with the operation of this Service or place an excessive load on the system
  8. Acts that attempt to access the Company's network or system without authorization
  9. Acts that collect or accumulate personal information about other Users
  10. Acts that use this Service for purposes other than those intended
  11. Acts that cause disadvantage, damage, or discomfort to other Users or third parties
  12. Acts that transfer or lend login information to a third party
  13. Other acts that the Company deems inappropriate

Article 9 (Intellectual Property Rights)

  1. All intellectual property rights related to this Service belong to the Company or the rights holders who have granted the right of use to the Company.
  2. Users shall not use, copy, modify, distribute, sell, or lease any content obtained through this Service beyond the scope permitted by the Company, nor shall they create derivative works based on such content.

Article 10 (Handling of User Content)

  1. The Company may use content posted by Users on this Service (including resume information) for the operation, improvement, and promotion of this Service.
  2. The Company shall not be obligated to back up content posted by Users.

Article 11 (Disclaimer)

  1. The Company shall not guarantee that there are no defects (including security vulnerabilities, errors or bugs, infringement of rights, etc.) in this Service.
  2. The Company shall not be responsible for any damages incurred by Users as a result of using this Service, except in cases of intentional or gross negligence on the part of the Company.
  3. The Company shall not be involved in or responsible for any transactions, communications, or disputes between Users or between Users and third parties in relation to this Service.
  4. The Company shall not guarantee the accuracy, reliability, or usefulness of information obtained through this Service.

Article 12 (Damages)

  1. If a User causes damage to the Company by violating these Terms, the Company may claim compensation for such damage from the User.
  2. If the Company is liable for damages to a User, the Company shall only be liable for direct and actual ordinary damages suffered by the User when the Company is negligent.

Article 13 (Changes to the Terms)

  1. The Company may change these Terms in the following cases, if it is in the general interest of Users or if there is a reasonable cause:
    1. When it is necessary to respond to changes in laws or social circumstances
    2. When it is necessary for the operation of this Service
    3. Other cases where the Company deems it reasonable
  2. When the Company changes these Terms based on the preceding paragraph, it shall announce the content and effective date of the changed Terms on the Company's website or this Service, and shall apply them after a certain period.
  3. If a User continues to use this Service after the Terms have been changed, they shall be deemed to have agreed to the change.

Article 14 (Changes, Suspension, or Termination of the Service)

  1. The Company may change, suspend, or terminate all or part of this Service after announcing it on this Service in advance.
  2. In case of emergency, the Company may suspend or terminate all or part of this Service without prior notice to Users.
  3. The Company shall not be responsible for any damages incurred by Users or third parties due to the change, suspension, or termination of this Service.

Article 15 (Exclusion of Anti-Social Forces)

  1. Users represent and warrant that they do not belong to or have any relationship with anti-social forces.
  2. The Company may refuse or cancel member registration without prior notice if a User is found to be or is suspected of being an anti-social force.

Article 16 (Severability)

Even if any provision of these Terms or any part thereof is found to be illegal or invalid, the remaining provisions shall continue to be fully effective.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of Japan.
  2. Any disputes arising from these Terms or this Service shall be subject to the exclusive jurisdiction of the Tokyo District Court or Tokyo Summary Court as the court of first instance, depending on the amount in dispute.

These Terms shall be effective from January 29, 2025.
